Giveaway General Terms & Conditions
Effective Date: October 1, 2026
These Product Giveaway General Terms & Conditions (the “General Terms”) apply to every online product giveaway (each, a “Giveaway”) sponsored by Prince of Peace Enterprises, Inc. a California corporation with its principal place of business at 751 N. Canyons Parkway, Livermore, CA 94551 (“POP,” “we,” “us,” or “our”). Each Giveaway is also governed by the event-specific rules that POP publishes for that Giveaway (the “Event Rules”). The General Terms and the Event Rules together are the “Official Rules.” If the Event Rules conflict with these General Terms, the Event Rules control for that Giveaway, except that the Event Rules may not make eligibility less restrictive than Section 1 or conflict with applicable law.
Giveaways are open to adults only. Please read the Official Rules before entering. By entering, you agree to them.
1. Eligibility
1.1 Adults only. You must be at least 18 years old, and at least the age of majority in your state of residence if that age is higher than 18, on the date you enter.
1.2 Eligible Territories. Unless the Event Rules say otherwise, Giveaways are open only to residents of the 50 United States and the District of Columbia. The Event Rules may exclude particular states or territories.
1.3 Who may not enter. Employees, officers, directors, contractors, and agencies of POP, its affiliates, and its prize and promotional suppliers, and members of their immediate families or households, are not eligible.
1.4 No minors. Giveaways are not directed to anyone under 18, and we do not knowingly collect information from anyone under 18. If we learn that an entrant is under 18, the entry will be disqualified and the entrant’s information will be deleted. We may ask for proof of age and residence at any time.
1.5 Void where prohibited. Giveaways are subject to all applicable federal, state, and local laws and are void where prohibited or restricted by law.
1.6 Agreement. Participation constitutes full and unconditional agreement to the Official Rules and to POP’s decisions, which are final and binding on all matters relating to the Giveaway, to the extent permitted by law.
2. Free Entry
Enter during the entry period using the free method and entry limits in the Event Rules. Submit accurate information and enter only for yourself. No purchase, donation, paid subscription, shipping payment, or other payment to Company or its designee is required to enter or claim a prize. A product purchase or marketing subscription does not improve selection priority, judging scores, or odds.
2.1 Entry method. The Event Rules describe how to enter, the entry period, and the free method of entry. All entries must be received within the entry period. Unless the Event Rules say otherwise, all times are Pacific Time (PT).
2.2 Entry requirements. Entries must be complete, accurate, and submitted by the entrant personally. Entries submitted by bots, scripts, macros, entry services, or any automated means are void. Entries are not returned or acknowledged. POP is not responsible for late, lost, misdirected, incomplete, or illegible entries, whatever the cause.
2.3 Social media entries. If an entry method asks you to post, tag, or share on a social media platform, your post must follow that platform’s terms and must comply with the U.S. Federal Trade Commission’s Endorsement Guides.
3. Winner Selection, Notification, and Prizes
3.1 Selection. The Event Rules state how winners are chosen: by random drawing from eligible entries, or by judging against published criteria. For a random drawing, the odds of winning depend on the number of eligible entries received. The date on which winners are determined is stated in the Event Rules.
3.2 Notification and verification. Potential winners will be notified by the method stated in the Event Rules and must respond within the period stated there. Before a prize is awarded, POP may require a potential winner to verify his or her identity, age, and residence and to sign an affidavit of eligibility, a liability and publicity release, and any tax form required by law. If a potential winner is ineligible, declines, fails to respond by the disclosed deadline, or cannot be reached after the disclosed attempts, POP will use the published alternate-selection procedure. POP will award the advertised prizes as required by law and will not withhold them merely because participation is lower than expected.
3.3 Prizes. Prizes are described, with their approximate retail value, in the Event Rules. No substitution, transfer, or cash equivalent is allowed, except that POP may substitute a prize of equal or greater value if the stated prize becomes unavailable. Unless the Event Rules say otherwise, POP will pay standard shipping to a winner’s delivery address within the eligible territory, and will ship prizes to addresses in the United States only. Prizes are limited to one per person or household as specified in each Event Rules.
3.4 Taxes. Winners are solely responsible for all federal, state, and local taxes and any other costs related to receiving or using a prize. POP will report prizes to the IRS and state tax authorities where required by law and may require a winner to provide a Form W-9 or other tax information before the prize is delivered. Sensitive information must not be posted in public comments or sent through an unverified account. POP will never require a fee to release a prize.
4. Entrant Content and Intellectual Property
This section applies if a Giveaway asks you to submit photos, videos, text, or other materials (a “Submission”).
4.1 Your promises. By submitting a Submission, you confirm that you created it and own all rights in it (or have permission from everyone who does), and that it does not infringe or violate anyone’s copyright, trademark, privacy, publicity, or other rights, or any law.
4.2 Content standards. A Submission must not be unlawful, obscene, defamatory, harassing, hateful, misleading, or sexually explicit, and must not disclose another person’s private information. POP may remove any Submission and disqualify any entry that does not meet these standards.
4.3 People in your Submission. You are responsible for making sure that every person who appears in your Submission has consented to being featured and to the uses described in Section 4.4. Do not include a minor unless that person’s parent or legal guardian has consented.
4.4 License to POP. You keep ownership of your Submission. You grant POP and its affiliates and service providers a worldwide, royalty-free, non-exclusive, sublicensable license to use, display, reproduce, edit, adapt, and share your Submission, including by reposting it on POP websites, social media accounts, and promotional materials, without additional notice, approval, or compensation. To the extent permitted by law, you waive any moral rights in your Submission for these purposes. This license lasts for the period reasonably necessary for those purposes, including required record retention.
5. Publicity
By accepting a prize, a winner consents to POP’s use of his or her name, city and state of residence, likeness, voice, and statements about the Giveaway to announce the winner and to promote POP and its products, in any media, without additional notice, approval, or compensation, except where prohibited by law. POP will not otherwise use a non-winning entrant’s name or likeness without that person’s consent, other than as part of a Submission under Section 4.4 or where law requires.
6. Privacy and Communications
6.1 Use of personal information. POP collects the personal information you provide when you enter (such as name, email address, social media handle, and, for winners, mailing address, telephone number, and tax information). We use your personal information to run the Giveaway, verify eligibility, deliver prizes, prevent fraud, and meet legal obligations. We may share information with service providers that help us run the Giveaway and deliver prizes, and as required by law. We may send communications reasonably necessary to administer your entry or prize. Provide sensitive verification information only to POP’s official communication channel. 6.2 Marketing. Entering a Giveaway does not sign you up for marketing emails or text messages. We will send them only if you separately opt in, as required by law, and you may opt out at any time.
7. Release, Disclaimer, and Limitation of Liability
7.1 Release. To the fullest extent permitted by law, by entering you release and hold harmless POP, its affiliates, prize and promotional suppliers, and their respective officers, directors, employees, and agents (the “Released Parties”) from any claim, loss, injury, or damage of any kind arising out of your participation in the Giveaway, your Submission, or the receipt, use, or misuse of a prize. This release does not apply to claims arising from a Released Party’s fraud, willful misconduct, gross negligence, or violation of law.
7.2 California Civil Code §1542 waiver. If you are a California resident or the claims are governed by California law, you expressly waive the benefit of California Civil Code Section 1542 (and any similar law of any other state) as to the claims released in Section 7.1. Section 1542 states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”
7.3 Disclaimer. To the fullest extent permitted by law, prizes are awarded “AS IS,” without warranty of any kind, express or implied, by POP, except that any manufacturer’s warranty passes through to the winner. Use products only as labeled, and review ingredients, allergens, warnings, and any age or use restrictions. Receiving a product is not medical advice or a representation that the product is appropriate for every recipient. POP is not responsible for technical, hardware, software, network, or platform failures; unauthorized human intervention; or typographical or other errors in the Official Rules or in any Giveaway materials.
7.4 Limitation of liability. To the fullest extent permitted by law, the Released Parties will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the Giveaway, and their total liability for any claim will not exceed the retail value of the prize awarded to the claimant. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
8. Entry Integrity, Cancellation, and Disqualification
8.1 Disqualification. POP may disqualify any entry or entrant, and may refuse to award a prize, if it reasonably believes that the entrant has violated the Official Rules, provided false information, used multiple identities or accounts, used automated means, tampered with the entry process or the operation of the Giveaway, or acted in a disruptive or abusive manner.
8.2 Cancellation or modification. POP may cancel, suspend, or modify a Giveaway if fraud, technical failure, human error, natural disaster, a legal or regulatory requirement, or any other cause beyond POP’s reasonable control corrupts or impairs its administration, security, fairness, or proper operation. If a Giveaway is cancelled after entries have been received, POP may select winners from the eligible entries received before the event. Any change will be posted where the Event Rules are published.
8.3 Decisions. POP’s decisions about the administration and interpretation of the Official Rules, entry eligibility, and winner selection are final and binding, to the extent permitted by law.
9. Social Media and Third-Party Platforms
No Giveaway is sponsored, endorsed, administered by, or associated with Instagram, Facebook, TikTok, YouTube, X, Pinterest, Amazon, or any other social media platform or third-party service used in connection with it. You are providing your information to POP. Questions, comments, and complaints about a Giveaway should be directed to POP, not to a platform. POP, rather than the platform, administers the Giveaway. Entrants must comply with applicable platform terms; no entry action may require inaccurate tagging or violate those terms. Where required by a participating platform and permitted by law, entrants release that platform from claims arising solely from POP’s administration of the Giveaway. The Event Rules identify the participating platforms and include any additional required platform language.
10. Governing Law and Disputes
10.1 Governing law. The Official Rules and all Giveaways are governed by the laws of the State of California and, where applicable, the federal laws of the United States, without regard to conflict-of-laws principles.
10.2 Informal resolution and venue. Before filing a claim, you agree to send POP a written description of the dispute at the address in Section 13 and to allow 30 days to resolve it. Any claim that is not resolved must be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the personal jurisdiction and venue of those courts.
10.3 Your rights. Nothing in these General Terms limits any consumer right that cannot be waived under the law of your state of residence.
11. Changes to These General Terms
POP may update these General Terms at any time by posting the updated version at https://www.popus.com › pages › giveaway-general-terms-conditions. An update does not apply to a Giveaway that has already begun; each Giveaway is governed by the version in effect on its start date.
12. General
If any provision of the Official Rules is held unenforceable, the remaining provisions stay in effect. POP’s failure to enforce any provision is not a waiver of it. The Official Rules are the entire agreement between you and POP about the Giveaway. POP may assign its rights and obligations under them.
