Directly from you

We collect personal information you provide, such as when you make a purchase, contact us, respond to a survey, provide information to us in person at a warehouse or street fair, sign up to receive emails, text messages, and/or postal mailings.

Security and Fraud Prevention

We use personal information to detect, investigate, prevent, or take action regarding possible malicious, deceptive, fraudulent, or illegal activity, including fraudulent transactions, attempts to manipulate or violate our policies, procedures, and terms and conditions, security incidents, and harm to the rights, property, or safety of our users, customers, employees, or others.

We use personal information to support core business functions, including to maintain records related to business process management; loss and fraud prevention, and to collect amounts owing to us; and to provide and maintain the functionality of our website including identifying and repairing errors or problems.

In addition to the specific situations discussed elsewhere in this privacy policy, we disclose personal information in the following circumstances:

Service Providers

We share certain personal information with third parties that perform services to support our core business functions and internal operations including: fulfilling orders, delivering packages, complying with your request for the shipment of products to or the provision of services by a third party intermediary, sending postal mail, emails and text messages, analyzing customer data, providing marketing assistance, supporting beacons, processing credit card and debit card payments, investigating fraudulent activity, conducting customer surveys, and providing customer service.

Once your information is provided to the third party it will be handled in accordance with their privacy policy. We currently share data with the following third party partners: Shopify, Product Filter & Search, Selly United, ShippingEasy, Translate & Currency - LangShop, Thrive Agency, PayPal, Linkmind Media, Mailchimp, Google Pay, and Citcon.

Legal Obligations

We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, warrant, court order, government inquiries, or other lawful request for information we receive. Right to Access, Update, Correct, and Delete Personal Information

Identity Verification

For us to process some requests, we will need to verify your identity to confirm that the request came from you. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address, or a phone number you have used with us. For certain requests, we may also ask you to provide details about the most recent purchase you made.

Authorized Agent

Depending on your state of residence in the U.S., you may designate an authorized agent to submit a request on your behalf to access or delete your personal information. To do so, you must: (1) provide that authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us. Notice of Financial Incentive/ Bona Fide Loyalty Program Disclosure

We offer our customers the ability to participate in promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law or a “bona fide loyalty program” under Colorado law. We do not sell your personal information as defined under Nevada law. However, to request email confirmation that we do not sell your personal information, please send an email to contact@popus.com with “Nevada Opt-Out of Sale” in the subject line and in the body of your message. We will provide the requested information to you via an email response.

Right to portable data

Upon a verified request, and to the extent technically feasible, the controller must: (a) provide to the consumer a copy of all of, or a portion of, as designated in a verified request, the consumer’s personal data in a structured, commonly used and machine-readable format and (b) transmit the data to another person of the consumer's or their agent’s designation without hindrance.

Right to Limit the Use of Sensitive Personal Information

We only collect sensitive personal information, as defined by applicable privacy laws, for the purposes allowed by law or with your consent. We do not collect or process sensitive personal information for the purpose of inferring characteristics about you.

Some of the purposes for the collection and processing of sensitive personal information allowed by law include: to perform the services or provide the goods reasonably expected; to prevent, detect, and investigate security incidents; to resist malicious, deceptive fraudulent, or illegal actions and to prosecute those responsible for those actions; to ensure the physical safety of natural persons; for short-term, transient use; to perform services; and to verify or maintain the quality or safety of a product or service.

Therefore, we do not offer the right to limit the use of sensitive personal information.

Right to Non-Discrimination

7. Minors

The Site is not intended for individuals under the age of 16. We do not intentionally collect Personal Information from children. 9. Response Time Frame

Once you have submitted your request, we will confirm receipt of your request(s) within five (5) business days and try to provide a response within forty-five (45) calendar days. In situations of necessity and complexity, we may extend the response period up to additional fifteen (15) calendar days. We will inform you about any extension and the reason within the initial 45-day period.

 

10. Retention Period

We retain personal information only as long as necessary and in alignment with our record-keeping schedules. Personal information may be retained to comply with applicable law, adhere to contractual requirements, in anticipation of litigation or a legal matter, or as otherwise necessary and proportionate to provide you with a product or service. When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. Residual anonymous information and aggregate information, neither of which identifies you (directly or indirectly), may be stored indefinitely.

We calculate retention periods for your personal information in accordance with the following criteria:
(1) the length of time necessary to fulfill the purposes we collected it;
(2) the length of time needed to keep records to demonstrate that we have fulfilled our duties and obligations;

Upon reaching the end of the necessary retention period or upon receiving your request to delete, we will securely and safely erase the personal information from our records.

Sensitive Data Opt-In & Withdrawal

We will honor up to two free requests per calendar year per consumer.
Additional requests may incur a reasonable fee or, if manifestly unfounded or excessive, may be refused with explanation.

Downstream Notification
If we correct or delete your data, we will notify all known processors and third parties who received that data in the prior 12 months (unless impossible or disproportionately burdensome).

 

13. Information for Residents Outside the USA

If you are located outside the United States, please note that some parts of this Privacy Policy may not apply. Please note that we process and store your personal information in the United States and other jurisdictions where our service providers operate. By using our services, you acknowledge that your data may be transferred to and processed in these locations. We take steps to ensure your information is protected in accordance with applicable privacy laws.

Automatic decision-making

We engage in fully automated decision-making that has a legal or otherwise significant effect using customer data. Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you. Services that include elements of automated decision-making include:

Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.
